Terms of Use

These Terms of Use (the "Terms") are an agreement between you and Gamify ("Gamify", "we", "us" or "our") about your use of the Gamify iOS app, the website at trygamify.io, and any related services (together, the "Service"). By signing in or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

1. Who can use Gamify

You must be at least 13 years old (or the minimum age required in your country) to use the Service, and old enough to agree to these Terms. You need an Apple ID to sign in, and you are responsible for everything that happens under your account.

2. What Gamify does

Gamify builds games from your descriptions using an artificial-intelligence model. The games are generated software: they may not work the way you expect, may contain mistakes, and may differ each time. You are responsible for reviewing anything you share.

3. Your content

You own the games you create and the comments you post. So that we can operate and promote the Service, you grant us a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, adapt, display, perform and distribute your content as needed to run the Service, including showing games you share on Explore and on public links. You confirm that you have the rights you need to the content you submit, including anything you upload as a reference.

4. Rules for content and conduct

Explore and comments are a shared space, and we have no tolerance for objectionable content or abusive behaviour. You agree not to create, share or post anything that:

• is pornographic, sexually explicit, or sexualises minors in any way;
• is hateful, harassing, threatening, bullying or defamatory, or targets anyone because of who they are;
• depicts or encourages violence, self-harm, dangerous activities or illegal acts;
• infringes someone else's copyright, trademark or other rights, or impersonates another person or organisation;
• is spam, misleading, or attempts to collect other people's personal information;
• contains malicious code, attempts to break out of the game's sandbox, or interferes with the Service or other users;
• breaks any law or Apple's App Store rules.

We review every report of such content within 24 hours and remove content that breaks these rules. We may take a game off Explore, delete comments, suspend or terminate accounts, and report illegal activity to the authorities, with or without notice. Repeated or serious violations end your access to the Service.

5. Reporting and blocking

Anyone can report a game or a comment from the app, and block another user. Blocking hides that person's games and comments from you and yours from them. Reports go to Gamify and are handled as described above; we do not tell the person who reported them.

6. Credits and purchases

Building games uses credits. Credits are bought through the App Store as consumable in-app purchases, are added to your account once Apple confirms the purchase, never expire, and have no cash value. They cannot be transferred, exchanged or refunded by us; refund requests go to Apple under Apple's policies. If Apple refunds a purchase, the corresponding credits are removed from your account. Prices and the cost of building may change.

7. The Service and your account

We may change, suspend or discontinue any part of the Service at any time. You can delete your account from within the app, which removes your personal information and your games as described in the Privacy Policy. We may suspend or terminate your account if you break these Terms or if required by law.

8. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Service, or any game made with it, will be error-free, uninterrupted or safe, or that generated games will be fit for any purpose.

9. Limitation of liability

To the fullest extent permitted by law, Gamify will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim.

10. Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms here with a new effective date, and, for material changes, may provide additional notice in the app. Your continued use of the Service after an update means you accept the new Terms.
